Terms and Conditions

No Commission if our appraisal is not met.

Pacta Real Estate shall not be entitled to receive any commission if the property is sold at a final sale price below the agreed appraisal value, subject to the following conditions:
 
Definitions: 

We/Pacta Real Estate (Win Square Pty Ltd t/a Pacta Real Estate) 

Vendor(s) – Owner(s) of the subject property offered for sale.  

1. Offer by discretion:

Win Square Pty Ltd t/a Pacta Real Estate reserves the right whether they are making this offer available to the vendor(s) or excluding this offer from certain agency agreements. If the special agreement is not signed to confirm this offer to the vendor(s) along with agency agreement, then this offer does not apply. 

2. Limited time offer:

Pacta Real Estate reserves the right to withdraw this offer without any notice. This offer expires on 31 December 2025 

3. Exclusive Agency Agreement:

This offer applies only for the properties where vendor(s) have entered into an exclusive agency agreement with Pacta Real Estate. Terms and conditions of exclusive agency agreement apply.  

4. Documented Appraisal Value:

The agreed appraisal value must be recorded in writing in the agency agreement and signed by both the sales agent and the vendor(s) at the time of entering into the exclusive agency agreement.

5. Sale by Auction Only

The vendor(s) and agent agree that this offer will only apply to the property where the vendor(s) has signed the exclusive agency agreement for sale of property by auction.

6. Validity period:

Offer would only apply while the exclusive agency agreement stands. Termination of exclusive agency agreement would terminate this offer.  

7. Pre or Post Auction Sale:

If the property is sold during the exclusive agency period and prior to the auction or after auction if property is ‘passed in’ in the auction —whether by the agent, the vendor(s), or another party—the agent shall be entitled to the commission as agreed as long as appraisal is met. 

8. Commission Condition Basis:

The vendor(s) agrees that this condition forms part of the commission arrangement and reflects a mutual understanding of the property’s expected market value at the time of entering into the agency agreement. 

9. Reserve Price:

A reserve price must be agreed upon by both parties and documented in writing at the time of signing the exclusive agency agreement. This offer would void if vendor(s) decides to increase the reserve price of the property which was decided at the time of the agency agreement.  

10. Vendor(s) Commitment to Sale Readiness:

The vendor(s), at their own cost, agrees to make arrangements to enhance the property’s presentation, marketability, and potential sale price—such as undertaking cleaning, cosmetic repairs, decluttering, and general maintenance—as recommended by the agent. The agent may provide suggestions for these improvements to support the property’s appeal and overall sale potential. 

11. Marketing Package:

The vendor(s) agrees to opt in and pay for the premium marketing package as offered by Pacta Real Estate. 

12. Open Homes:

There shall not be any changes made to the open home days and times scheduled by agent of Pacta Real Estate. Property must be cleaned, decluttered and made presentable prior to each open home e.g. beds made with clean bedsheets and pillows, property floors mopped, lawn mowed, kitchen cleaned etc.  

13. Arrangement with tenants:

If the property is leased, the vendor(s) must make arrangements with the tenant(s) to comply with condition number 11 and 12.  

14. Auction date:

No changes shall be made to the auction date and time agreed at the time of agency agreement.  

15. Terms and Conditions of agency agreement apply:

This agreement does not overwrite any terms and conditions of the agency agreementIn case of any contradiction, the terms and conditions of agency agreement would prevail.
